Terms of Service

1. Agreement

These Terms are an agreement between you and Beacon Light Investments ("we", "us"), governing your use of BYTE — the website at byte.gorged.io and the mobile application, together "the game" or "BYTE". By playing, you agree to these Terms. If you do not agree, do not use BYTE.

2. Who may use BYTE

BYTE is intended for players aged 13 and over. If you are under the age of majority where you live, you may only use BYTE with the involvement of a parent or guardian who agrees to these Terms on your behalf.

3. Your licence to play

We grant you a personal, non-exclusive, non-transferable, revocable licence to download (where applicable) and use BYTE for your own entertainment, subject to these Terms. This licence does not give you any ownership in BYTE or its content.

You agree not to:

  • reverse-engineer, decompile, or extract the game's source or assets, except as permitted by applicable law;
  • use cheats, exploits, automation (bots, macros), or unauthorised third-party software to affect gameplay;
  • interfere with or disrupt the game's servers or other players' ability to play;
  • use BYTE for anything unlawful, or to harass, abuse, or harm another person; or
  • resell, sublicense, or commercially exploit BYTE without our written permission.

4. Accounts, email and banked totals

BYTE has no accounts and nothing to log into. You may enter an email address; it only files your history (kills, pellets, your biggest block and anything you bank) under one record so it follows you across runs. It is not a login, we do not verify it, and you must not enter one that is not yours. If accounts are ever added, these Terms and the privacy policy will be updated first.

Blocks, scores, history, leaderboard places and banked totals are part of the game. They are not property you own, have no monetary value, and cannot be bought, sold or exchanged. We may reset, correct or remove any of them — for example after a rules change, to fix a bug, or if we believe they were gained unfairly.

5. The service can change

BYTE is a live service. We may add, remove, or change features, worlds, balance, or availability at any time, and may suspend or discontinue the game entirely. We will try to give notice of anything material, but nothing here guarantees BYTE, or any particular feature of it, will always be available.

6. Fair play and enforcement

We may suspend or terminate your access to BYTE, without notice, if we reasonably believe you have violated these Terms — in particular section 3's rules against cheating, exploiting, or disrupting the game for others.

7. Disclaimers

BYTE is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. We do not warrant that the game will be uninterrupted, error-free, or free of harmful components.

8. Limitation of liability

To the maximum extent permitted by law, Beacon Light Investments will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or goodwill, arising from your use of BYTE. Where liability cannot be excluded, it is limited to the greatest extent the law allows.

9. Indemnity

You agree to indemnify and hold Beacon Light Investments harmless from any claim arising from your violation of these Terms or your misuse of BYTE.

10. Termination

You may stop using BYTE at any time. We may suspend or terminate your access as described in section 6, or discontinue the game as described in section 5. Sections that by their nature should survive termination — including 7, 8, 9, 13, and 15 — will survive it.

11. Governing law and disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the state courts located in Hillsborough County, Florida and the United States District Court for the Middle District of Florida, Tampa Division, for any dispute, except that either of us may seek injunctive relief in any court with jurisdiction to protect intellectual property.

If you are a consumer in the EU, the UK, or another place whose law gives you the right to bring proceedings in your own country and under your own consumer law, nothing here takes that right away.

Before filing anything, please email us. Most disputes are a misunderstanding and are resolved faster in an inbox than in a courtroom.

12. Apple App Store

Where you obtain BYTE from Apple's App Store, the following applies and prevails over anything inconsistent above:

  • These Terms are between you and us only, not with Apple. We, not Apple, are solely responsible for BYTE and its content.
  • Your licence to use BYTE is limited to use on Apple-branded devices you own or control, as permitted by the App Store Terms of Service.
  • Apple has no obligation to provide maintenance or support for BYTE. Support requests go to us, at kyled@beaconlightinvestments.com.
  • If BYTE fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to BYTE.
  • We, not Apple, are responsible for addressing any claim relating to BYTE, including product liability claims, any claim that BYTE fails to conform to a legal requirement, and claims under consumer protection or similar legislation.
  • We, not Apple, are responsible for investigating and defending any third-party claim that BYTE infringes that party's intellectual property rights.
  • You represent that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.

13. Your content

If BYTE ever lets you submit a name or other content, you keep ownership of it, but grant us a licence to display it within the game as intended (for example, showing your chosen name to other players).

14. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. We may update these Terms from time to time; continuing to use BYTE after an update means you accept the revised Terms.
